Terms of Service

Welcome to HJDating. These Terms of Service ("Terms") govern your access to and use of the HJDating mobile application and related services (collectively, the "Service") provided by HJDating ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

  • You must be at least 18 years of age to use HJDating. By using the Service, you represent and warrant that you are at least 18 years old.
  • HJDating is currently available only in the United States. By using the Service, you represent that you are located in the United States.
  • You must not be prohibited from using the Service under applicable law or have been previously banned from the platform.
  • You may only maintain one active HJDating account at a time.

2. Account Responsibilities

  • You are responsible for maintaining the security of your account, including your phone number and any associated Apple ID.
  • You agree to provide accurate, current, and complete information in your profile. Misrepresenting your identity, age, or other profile information is prohibited.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately if you suspect unauthorized access to your account.

3. Acceptable Use

You agree not to:

  • Harass, bully, stalk, intimidate, or threaten any other user.
  • Post or send content that is hateful, discriminatory, violent, sexually explicit (beyond what is permitted in profile photos), or otherwise offensive.
  • Create fake or misleading profiles, impersonate another person, or use someone else's photos without permission.
  • Spam other users, including sending unsolicited commercial messages or mass messaging.
  • Solicit money or financial information from other users, or engage in scams or fraud.
  • Use the Service for commercial purposes, advertising, or promotion without our prior written consent.
  • Attempt to access another user's account, or the Service's systems, networks, or data without authorization.
  • Use automated tools (bots, scrapers, crawlers) to access the Service or collect user data.
  • Upload viruses, malicious code, or any material that could disrupt the Service.
  • Circumvent or interfere with security features, rate limits, or moderation systems.
  • Use the Service if you are a registered sex offender.

We reserve the right to investigate violations and take appropriate action, including suspending or terminating your account, banning your identifiers, and reporting illegal activity to law enforcement.

4. Subscription Terms and In-App Purchases

  • HJDating offers a free tier and optional paid subscription plans (Basic and Premium) with enhanced features.
  • All subscriptions and in-app purchases (consumables such as Power Hearts, Spotlights, Messages Before Match, Match Keys, and Popular Page placements) are processed through Apple In-App Purchase.
  • Subscription pricing and billing cycles are displayed in the app and on the App Store before purchase. Prices may vary by region.
  • Subscriptions automatically renew unless you cancel before the end of the current billing period. You can manage and cancel subscriptions through your Apple ID account settings.
  • Refunds for subscriptions and in-app purchases are handled by Apple in accordance with Apple's refund policies. We do not process refunds directly.
  • We reserve the right to change subscription pricing with reasonable notice. Price changes will not affect your current billing period.
  • Consumable purchases (Power Hearts, Spotlights, etc.) are non-refundable once used.
  • Advertisements: Users on the Free plan will see advertisements served by Google AdMob approximately every 10 profiles browsed. Paid plans (Basic and Premium) provide an ad-free experience.

5. Content Ownership and License

  • Your Content: You retain ownership of all content you post on HJDating, including photos, bio text, and messages ("User Content").
  • License to HJDating: By posting User Content, you grant HJDating a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Service. This license ends when you delete your content or account (subject to our data retention policy).
  • HJDating Content: The Service, including its design, features, trademarks, and proprietary content, is owned by HJDating and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our content without permission.
  • Feedback: If you provide suggestions or feedback about the Service, we may use it without obligation to you.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

7. Termination

  • By You: You may delete your account at any time through the app. Upon deletion, your profile becomes immediately invisible, and all personal data is permanently purged within 30 days.
  • By Us: We may suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, engaged in harmful behavior, or for any other reason at our sole discretion.
  • Bans: If your account is terminated for violations, we may ban your phone number and Apple ID from creating new accounts.
  • Effect of Termination: Upon termination, your right to use the Service ceases immediately. Active subscriptions are not refunded upon termination for violations (refund requests can be directed to Apple).

8. Disclaimers

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.
  • We do not guarantee the accuracy of user profiles, the behavior of other users, or that you will find a match.
  • We do not conduct criminal background checks on users.
  • We are not responsible for interactions between users, whether online or offline. You use the Service and meet other users at your own risk.
  • We do not guarantee that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law:

  • HJDating and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total aggregate liability for any claims related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.
  • This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise).

10. Indemnification

You agree to indemnify and hold harmless HJDating, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Dispute Resolution

  • Informal Resolution: Before filing any formal claim, you agree to contact us at contact@techcreations.llc and attempt to resolve the dispute informally for at least 30 days.
  • Arbitration: Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in the state of New Jersey.
  • Class Action Waiver: You agree that disputes will be resolved on an individual basis. You waive the right to participate in a class action, class arbitration, or representative proceeding.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in New Jersey.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by other appropriate means. Your continued use of the Service after updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

14. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and HJDating regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
